Ohio (06/10/1968) is definitely intriguing; however, by my interpretation of the events, that particular search was reasonable. Although, I can't say the same for many of the cases in which that precedent was cited...

Justice Douglas strongly disagreed with permitting a stop and search absent probable cause:
"We hold today that the police have greater authority to make a 'seizure' and conduct a 'search' than a judge has to authorize such action. We have said precisely the opposite over and over again."[6]
"To give the police greater power than a magistrate is to take a long step down the totalitarian path. Perhaps such a step is desirable to cope with modern forms of lawlessness. But if it is taken, it should be the deliberate choice of the people through a constitutional amendment."

What we have with this ruling, is the first step into the arena of "Pre-crime", and we have seen how far that has developed as part of the 'drip-drip-drip' of ruling such as 'Terry'.
Intent is hard to prove, even in the past tense, let alone as a predictive.
A crime is not a crime until actually committed. The other thing that bothers is the issue of the 2nd Amendment that is in play and never addressed here.
Terry and Chilton were subsequently charged with carrying concealed weapons. It is my assertion that carrying weapons in the open or concealed is protected by the 2nd.
So we have a compounding cascade of diminishing rights tied up in this particular case - first relying on the fact of statutes against carrying weapons. Then extending to first Ybarra v. Illinois, Minnesota v. Dickerson,etc, as per traffic stop searches.
And then to Hiibel v. Sixth Judicial District Court of Nevada,requiring the suspect to identify himself during a Terry stop did not violate the Fourth Amendment prohibitions of unreasonable searches and seizures or the Fifth Amendment privilege against self-incrimination.
So we see here from this one case; 'Terry' we have advanced to the point of the Gestapo situation of "Show me your papers", and the problem of "ID" and the right to anonymity and privacy, unless actually found in the blatant commission of an actual crime.

ReplyDeleteWhich is quite vague enough to constitutionally permit searches that can be interpreted by the courts as not "unreasonable". Lots of discretion left to the Judiciary there... :-\
I definitely agree with Justice Douglas' dissent, but chose not to include this case precisely because it was one of those ‘drip-drip-drip’ cases, while the others were all in flagrant disregard to the Bill of Rights. However I do not intend to imply that this slow chipping away of our rights is in anyway acceptable!

The Key phrases historically have always been:
"Warrants" first and foremost, this strict technicality to prevent arbitrary practices from settling into law.
"probable cause, supported by Oath or affirmation."
This obviously rests on SPECIFICITY - again to avoid arbitrary practices, to build a pause of reflection for a concern for the axiom of 'innocent until proven guilty'.
The phrase "unreasonable" is a subjective assessment, and has therefore been seized by the post modern national state as a term of "plausibility" - that is a term that can be rhetorically manipulated.

Privilege is understood to be a grant from authority. Rights are seen as pre-existent and unalienable.
It should be of concern that the writ of habeas corpus is referred to as a 'privilege' in the body of the Constitution itself. This may be balanced or parsed somewhat as an authority of some sort is assumed as a integer in the formula. That is "someone has the body", and as a legal system that someone would be the state. So the state promise to 'grant' a lawful mechanism may be a reasonable construction.
I disagree with the philosophical argument I just made, but intuit it as possible as the ground of the thinking as to the wording used in the Constitution.

Independence day has sounds like a war here...in surround sound. Fireworks are legal here, and the civilians have been steady at it as the fairgrounds to the east and the plaza to the west...I swear someone out there has a real canon, I can feel the walls shake every time it goes off, and it goes off regular. It has been two - three hours of nonstop explosions and flashes in the sky. I am wondering when a cease fire is going to be called...it's 9:27PM here, I bet this goes on past midnight.

I rented the Bruce Willis film, 'A Good Day to Die Hard' [DVD] and watched yesterday.
ReplyDeleteStupid, but revealing. It reveals the wounded psychotic nature of the Amerikan fragmented and delusional mind.
Not only the hour long car chase, and the almost continuous shoot'm-up bullshit, but also the few moments of dialog which reveal the jejune and crippled nature of the Amerikan Macho-Man.
The film is nothing but an exploding turd.

If an artificial intelligence acts anything like the other 'intelligent' lifeforms we are aware of, one could assume that it would seek to dominate all resources with no regard to other living creatures (à la "The Terminator").
ReplyDeleteOr if for some reason, it required humans to survive; like cows through the slaughterhouse, so are the days of our Matrix...
While quite probable that some of The Powers That Believe would wish to entirely eliminate humans from the kill-chain, this actually represents a double-edged sword. For if they were to find their own names on such a death list, there would be no one to blackmail or bribe their way out. In the meantime, all these systems are designed, implemented, and executed by people. People prone to such pesky problems as having consciences, morals, and questioning towards authority.
