I laugh at VW's sleazy tricks where you have to opt out each of three options and save each one separately. Many will assume one save would do.

Telecomm companies are immune from lawsuits when complying with a FISA request - Dec. 30, 2011

The 9^th United States Circuit Court of Appeals confirmed that the FISA (Foreign Intelligence Surveillance Act) exempts telecommunications companies from all legal liabilities if they cooperate with government investigators by fulfilling a FISA request.  FISA allows the NSA (National Security Agency) to gather information on a phone or data call between a suspected terrorist number originating outside of the United States and a phone or electronic device inside the US.

Thirty-three separate lawsuits against many telecom companies were bundled together and then constitutionality considered.  The court came to the conclusion that FISA was constitutional in its application.

The EFF (Electronic Frontier Foundation) was one of the groups providing lawyers to sue the companies that cooperated with the NSA.  The ACLU also joined in the lawsuits.

The Legal Director of the Electronic Frontier Foundation, Cindy Cohn responded to the ruling: “I’m very disappointed. I think the court reaches to try to put lipstick on a pig here.  I think what Congress did was an abdication of its duty to protect people from illegal surveillance.”  Cindy actually argued the case in front of the 9^th Circuit Court.

Before these cases were bundled and sent to the 9^th Circuit Court, the government kept denying the right to sue because revelations in open court could put terrorist investigations in jeopardy.

If your neighbor was receiving calls from a terrorist group, would you want the government to be able to trace and monitor that call as it was happening?
